I think the "original" was also plagiarised, from Star Wars, so it's a case of the pot calling the kettle black.

The photo has a defeated looking Vader-boy sitting at a table.

The sculpture has a defiant looking Vader-boy sitting at a table.

Similar but not the same. If we are going to call it against the rules let's scrap Banksy's paintings, Vettriano's works based on photos of dancers and every person who does a parody of the mona lisa or the scream.

They should credit the original but the works are different enough to be unique. As pointed out any attempt at litigation may well spark so
e from Lucas or the makers of the novelty helmet.

If this is plagirism then ayone who has ever photographed a sculpture or statue is in the same position.

Incidenatlly I am the only one who thinks the photo is mediocre at best?

Going of topic slightly I am not sure Spielberg would have the right to sue.

I'd agree with Adam that the picture is banal at best - it's one of those things that, if you get a lot of people talking about it, you give it credence and so you can call it art.

I do think it is plagirism though; even if the sculptors thought it was an orphaned work they still copied it. The sort of thing might happen in writing where a newspaper article isn't given a credit and then you type it out word for word, blog it and call it your own. OK, it didn't have a credit on it, but you still knew you were copying it.

Oh, and I would say, as bland an image and sculpture as they are, there is no plagiarism here.

They have stated already that they "appropriated" an image with a large internet presence to create their work, thus creating a derivative of the original image, whether they credit the original creator or not.

Plagiarism would involve stealing the original idea, denying all knowledge of the original image, claiming the idea as their own entirely and presenting it as a new and original work, which they haven't done.
